New HUD Interim Rule Protects Tenants Facing Evictions for Non-Payment of Rent

HUD announced an Interim Rule that prohibits the eviction of tenants for nonpayment of rent from properties participating in HUD’s Multifamily Section 8 project-based rental assistance, Section 202, and Section 811 assisted housing programs and HUD-subsidized public housing without management first providing a 30-day notice period that includes information about available federal emergency rental assistance. This Interim Final Rule is effective November 8, 2021.

Special Claims Tips

Please review some of the more common issues with Special Claims submissions:

Make sure all signature and date lines are filled out
Ensure that the “Ready for Occupancy Date” is the day after work was completed on the unit
Ensure the contract rent listed on the Special Claims form is the contract rent on the move out cert
Ensure that the relevant certifications (move-outs and move-ins) have been submitted to TRACS prior to submitting the claim

COVID-19 Test Kits Are Available at Federally Qualified Community Health Centers

The U.S. Department of Health and Human Services/Health Resources & Services Administration is making at-home COVID-19 test kits available to their federally qualified community health centers (FQHC). FQHCs/community health centers will be able to request supplies on a regular basis to deliver at-home COVID-19 tests to their patients and their community partners. This includes people experiencing homelessness and residents of HUD-assisted housing.

If Multifamily owners/management agents would like access to at-home tests for residents, reach out to your FQHC/community health center partners.
